Alibaba Challenges DoD Designation in San Jose Federal Court
Chinese e-commerce giant Alibaba Group Holding has filed a federal lawsuit against the U.S. Department of Defense (DoD) in San Jose, California. The legal action challenges the DoD’s June 9, 2026, decision to add Alibaba, alongside tech giants Baidu, BYD, and Nio, to the “1260H” list of Chinese military companies. Alibaba argues that the designation is arbitrary, lacks factual basis, and violates due process rights.

Investor Deterrence and Impact on Corporate Partnerships
Although the 1260H designation does not trigger immediate asset freezes or severe economic sanctions, it bans new DoD contracts and deters U.S. institutional investors and commercial partners from working with listed entities. Alibaba’s legal team is seeking an immediate injunction to remove the company from the blacklist, claiming it causes ongoing reputational and financial harm.
